April 1, 2004                             Special Meeting                                            

                            

Trustee Kuvin called the meeting to order at 7:05 p.m. Members of the Board present were Trustee Kuvin and Trustee Speidel. Trustee Reed was not present, having recused herself due to conflict of interest and her absence was excused. Also present were Kristin Spiekerman, the Clerk and Greg Horwedel, Administrator.

 Stan Frey, an Elder of the North Cincinnati Community Church, led the invocation. Trustee Speidel led in the Pledge of Allegiance.

 Trustee Kuvin introduced the Board members, the Clerk, the Administrator and Law Director. He also explained Trustee Reed’s absence at the meeting and in future special meetings concerning this zoning case.

 Trustee Kuvin outlined for the public the procedural process for the meetings.

 Tim Mara, Attorney for certain residents, questioned Joe Trauth, Attorney for the Applicant.

 David Oakes, Chief Engineer for Wal-Mart, introduced himself and his staff.

 Trustee Kuvin opened the floor to questions from the public to Joe Trauth, Attorney for the Applicant. The following people responded.

 David Oakes addressed the Board. The Board then questioned David Oaks and his staff.

 A motion by Trustee Speidel and second by Trustee Kuvin to take a break. Motion carried.

 A motion by Trustee Kuvin and second by Trustee Speidel to return to Regular Session. Motion carried.

 Steve Dragon, with CDS Associates and the civil engineer for the outlot portion of the development, spoke regarding the proposed development.

 Jim Harkin, architect for the project, spoke regarding the proposed development.

 Howard Mayer, store manager of the Fields Ertel Wal-Mart spoke in support of the proposed development.

 Trustee Kuvin opened the floor to opponents of the proposed project. The following people responded.

Patricia Quill, 9245 Knights Ridge Lane

 Tim Mara made a presentation in opposition to the proposed development as legal counsel for certain residents.

 A motion by Trustee Kuvin and second by Trustee Speidel to continue this hearing to Monday, April 26, 2004. Motion carried.

 A motion by Trustee Kuvin and second by Trustee Speidel to adjourn. Motion carried.
