Regular Meeting

Trustee Romano called the meeting to order at 6:35 p.m. All members of the Board were present. Also present was Dan Evers, Administrator and Tom Swope, Law Director. The Fiscal Officer, Kristin Spiekerman, was absent with prior notice.

Fiscal Officer

A motion by Trustee Romano and second by Trustee Speidel to approve Warrants #49422 through 49444. Motion carried unanimously.

Board Action – New Business

Community Development

A motion by Trustee Speidel and second by Trustee Corey to approve the application for a modification to the approved Stage 3 plan for Deerfield Village Townehomes at Deerfield Village Square Road subject to the seven (7) recommended staff conditions and adding an eighth condition that the modified plan will have seventy-seven (77) parking places for buildings nineteen (19) and twenty (20). Motion carried unanimously.

A motion by Trustee Corey and second by Trustee Speidel to approve Case 2006-564 Stage 3 Final Detailed Plan application for the subject property subject to eleven (11) conditions as recommended in the staff report. Modifying condition #7 to read: Not to exceed 140 square feet in bullet point #1 and adding condition #12: Prior to application for the zoning certificate, the site plan shall be revised to eliminate the first two parking spaces on the west side of the entrance. Motion carried unanimously.

A motion by Trustee Romano and second by Trustee Corey to take a break. Motion carried unanimously.

A motion by Trustee Romano and second by Trustee Corey to return to regular session. Motion carried unanimously.

Public Comment

A motion by Trustee Romano and second by Trustee Speidel to approve Case 2006-369 Final Site Plan application for Holiday Inn Express in Deerfield Crossing subject to the fourteen (14) conditions as recommended by staff. Motion carried unanimously.

A motion by Trustee Romano and second by Trustee Corey to approve Case 2006-589 Stage 3 Final Detailed Plan application for the subject property of 2.57 acres located in Arbor Square west of Mason-Montgomery Road and east of Arbor Square Drive subject to twelve (12) conditions as recommended in the staff report. On roll call: Trustee Romano-yes, Trustee Corey-yes, Trustee Speidel-no. Motion carried.

Fiscal Officer – Kristin Spiekerman

A motion by Trustee Speidel and second by Trustee Romano to authorize the Fiscal Officer to pay Fifth Third Securities in the amount of $4,646.57 and to pay The Bank of New York in the amount of $450. Motion carried unanimously.

A motion by Trustee Romano and second by Trustee Speidel to approve Resolution 2006-71 with the following modifications. Sections 2 and 3 to be eliminated and Sections 4,5 and 6 to be renumbered and fix spelling of appropriations in header: A Resolution Reconciling Budgets and Amending Appropriations, Dispensing with the Second Reading and Declaring an Emergency. Motion carried unanimously.

A motion by Trustee Romano and second by Trustee Corey to table a Resolution authorizing transfer of funds. On roll call: Trustee Romano-yes, Trustee Corey-yes, Trustee Speidel-no. Motion carried.

A motion by Trustee Romano and second by Trustee Speidel to authorize the Fiscal Officer, Kristin Spiekerman, to pay the Mason School District $798,410.46 and Kings Local School District $199,077 from the appropriate TIF fund as determined by the Fiscal Officer. Motion carried unanimously.

Fire Department

A motion by Trustee Romano and second by Trustee Speidel to approve Resolution 2006-72 A Resolution Authorizing the Township Administrator, Daniel G. Evers, to Execute an Amendment to the Collective Bargaining Agreement Between Deerfield Township and the Deerfield Professional Firefighters Union, International Association of Firefighters, Local #4286, Dispensing with the Second Reading and Declaring an Emergency. Motion carried unanimously.

Public Works

A motion by Trustee Romano and second by Trustee Speidel to reject all the bids for the Irwin Simpson turn lane project opened on August 24, 2006. Motion carried unanimously.

A motion by Trustee Romano and second by Trustee Corey to approve a payment to Silver Hawke Construction in the amount of $107,007.25 from the 2003B General Reserve TIF Fund. Motion carried unanimously.

A motion by Trustee Romano and second by Trustee Speidel to approve Resolution 2006-73 A Resolution Agreeing with Warren County Commission to Accept a Public Street for Maintenance to Set Speed Limits on a Portion of Columbia Road and a Policy of No Thru Trucks on Columbia Road in Deerfield Township, Ohio and Dispensing with the Second Reading and Declaring an Emergency. Motion carried unanimously.

A motion by Trustee Speidel and second by Trustee Romano to accept the engineering proposal for the Kings Mills infrastructure upgrade from ME Companies for a cost of $65,250 and authorization for the Township Administrator to sign any applicable documents. Motion carried unanimously.

Administration

A motion by Trustee Corey and second by Trustee Romano to approve Resolution 2006-74 A Resolution Authorizing Appointment of Christopher Romano as a Member of the 9-1-1 Planning Committee and Dispensing with the Second Reading and Declaring an Emergency. Motion carried unanimously.

A motion by Trustee Romano and second by Trustee Speidel to approve Resolution 2006-75 A Resolution Granting the Employees the Right to Take Pay in Lieu of Vacation Time and Declaring an Emergency. Motion carried unanimously. 

Consent Agenda

Administration

A motion by Trustee Romano and second by Trustee Speidel to remove Patrick Strausbaugh, Career Firefighter/Paramedic DTFR, from probationary status effective November 7, 2006. Motion carried unanimously.

A motion by Trustee Romano and second by Trustee Speidel to remove Brian Bentley, Career Firefighter/Paramedic DTFR, from probationary status effective November 21, 2006. Motion carried unanimously.

A motion by Trustee Romano and second by Trustee Speidel to approve a payment to Matt Pulfer in the amount of $58 for training in diesel engine repairs. Motion carried unanimously.

Reports

Trustee Romano gave an update regarding the county jail. Trustee Romano also conveyed condolences to the family of Ray McMillian on the death of his mother.
