Regular Meeting

March 5, 2008

Trustee Corey called the meeting to order at 6:39 p.m. Trustee Romano and Trustee Patterson was present. Also present was Dan Evers, Administrator and Tom Swope, Law Director.

 

Trustee Romano led the Pledge of Allegiance.

 

A motion by Trustee Corey and second by Trustee Romano for Dan Evers to take minutes. Motion carried unanimously.

 

Public Comments

George Pitstick, 5915 Timber Rail Lane, spoke on the Fields Ertel corridor study.

 

Brad Price, 5862 Timber Rail Lane, spoke on the Fields Ertel corridor.

 

At Trustee Corey’s request, Lois McKnight (Community Development Director) gave a history of the Fields Ertel moratorium.

 

Lois McKnight read a letter from Janet Fette, 2406 Fields Ertel Road, regarding the Fields Ertel corridor.

 

Eloise Pitstick, 5915 Timber Rail Lane, spoke on the Fields Ertel corridor.

Fiscal Officer

A motion by Trustee Corey and second by Trustee Patterson to approve Purchase Orders #11044-2, 11090, 111091, 11093 through 11097 and Warrants #52116 through 52185 and 52068. Motion carried unanimously.

 

Board Action – New Business

Parks

Scott Pierce, President of Festivals of Mason, Inc., made a request to lease storage from the township.

 

A motion by Trustee Romano and second by Trustee Patterson to authorize the proposed lease agreement between Deerfield Township, Warren County and Festivals of Mason, Inc. and authorize the Township Administrator to execute this lease. Motion carried unanimously.

 

Community Development

Hayfaa Wadih, Urban Planning Analyst, presented Case No. 2007-575 Stage 2 Preliminary Site Plan Review and Stage 3 Final Detailed Plan for Performance Mitsubishi expansion.

 

Terry Brennan, with Brennan Builders, Inc. and representing the applicant, spoke on the request.

 

Trustee Corey asked if anyone was present to speak for or against the request. There were no speakers and Trustee Corey closed the public portion of the hearing.

 

A motion by Trustee Patterson and second by Trustee Romano to approve Case No. 2007-575 Stage 2 Preliminary Site Plan application for the subject property (Performance Mitsubishi) subject to the twelve (12) conditions as recommended by the Zoning Commission. Motion carried unanimously.

A motion by Trustee Patterson and second by Trustee Romano to approve Case No. 2007-575 Stage 3 Final Detailed Plan application for the subject property (Performance Mitsubishi) subject to twelve (12) conditions as recommended in the Staff Report. Motion carried unanimously.

 

A motion by Trustee Patterson and second by Trustee Romano to authorize training for the Board of Zoning Appeals to be conducted by McBride Dale Clarion on March 6, 2008 at a cost of $1,000 and authorize the Township Administrator to execute any agreements necessary to facilitate this training. Motion carried unanimously.

 

Fire Department

A motion by Trustee Patterson and second by Trustee Romano to adopt Resolution 2008-017 A Resolution Declaring Personal Properties as Surplus, Approving a Donation of Two Steel Containers to Butler Technology and Career Development School and Waiving a Second Reading. Motion carried unanimously.

 

Administration

A motion by Trustee Patterson and second by Trustee Romano to approve the payment of $25,000 to Warren County Soil & Water District per the 2007 executed Memorandum of Understanding between the two units of government. Motion carried unanimously.

 

A motion by Trustee Patterson and second by Trustee Corey to approve payment of $32,500 to Local 12 WKRC TV Cincinnati for the first payment for 2008 services. Motion carried unanimously.

 

A motion by Trustee Patterson and second by Trustee Romano to approve Resolution 2008-018 A Resolution Providing for and Authorizing the Reimbursement of Letter of Credit Fees to Terra Firma Associates for the Period of Time August 6, 2007 to November 5, 2007 and Dispensing with the Second Reading. Motion carried unanimously.

 

A motion by Trustee Romano and second by Trustee Patterson to approve Resolution 2008-019 A Resolution Accepting Funds from Warren County Commissioners for Two New Police Vehicles, Authorizing the Township Administrator to Enter an Addendum to the Contract between the Township, Warren County Sheriff and Warren County Commissioners for Police Protection Effective June 1, 2007, Dispensing with the Second Reading and Declaring an Emergency. Motion carried unanimously.

 

Minutes for Approval

A motion by Trustee Corey and second by Trustee Patterson to approve the January 15, 2008 meeting minutes, with the correction of Trustee Patterson’s name, and approve the January 25, 2008 meeting minutes. Motion carried unanimously. 

 

Consent Agenda

A motion by Trustee Corey and second by Trustee Romano to accept as a regular full time employee and approve a pay increase from $18.36 per hour to $18.86 per hour effective February 24, 2008. Mr. Clark is also eligible to use accumulated sick leave (240 hours) transferred from his previous employer, West Chester Township, effective February 24, 2008. Motion carried unanimously.

 

 

A motion by Trustee Corey and second by Trustee Romano to approve training for Marilyn Arnold on Microsoft Excel on May 13, 2008 at New Horizon’s Computer Learning Center, Blue Ash, Ohio at a cost of $225 plus travel. Motion carried unanimously.

 

A motion by Trustee Corey and second by Trustee Romano to authorize the registration of Fiscal Officer Kristin Spiekerman at the Ohio Township Association annual Winter Conference at a cost of approximately $40 and reimburse eligible travel expenses at a cost of approximately $371. Motion carried unanimously.

 

A motion by Trustee Corey and second by Trustee Romano to authorize Resolution 2008-020 A Resolution Authorizing the Issuance of Not to Exceed $16,280,000 of Various Purpose Renewal Notes, Deerfield Township, Ohio, Waiving the Second Reading and Declaring an Emergency. (The emergency provision is applicable due to the time-sensitive nature of the bond market and its impact on potential savings of tax dollars.) Motion carried unanimously.

 

Executive Session

A motion by Trustee Romano and second by Trustee Patterson to enter Executive Session to discuss pending/threatened litigation, personnel and property acquisition. Motion carried unanimously.
